Drug Testing Policy and Education

Banned Substance Use Prevention and Screening Policy

The Cameron University athletic, administrative, and coaching staff expressly condemns the

use of banned substances and the abuse of alcohol, as their use may endanger the safety

and health of the student-athlete. In an effort to address the problem of substance

abuse, the Department of Athletics has instituted educational programs and a Substance Abuse

Program for its student-athletes. The Athletics Compliance Department administers the policy on

behalf of the Athletics Department.

AGREEMENT TO COMPLY WITH BANNED SUBSTANCE USE

PREVENTION AND SCREENING POLICY

I am a student at Cameron University and participate as a student-athlete for the

Athletics Department. I recognize that the use of certain substances, which includes

the substances listed in Section 2 (except for medical use), is detrimental to my physical and

mental health. I further recognize and appreciate the interests of Cameron University

(“University”) in preventing the use of banned substances by members of all University athletic

teams and in the detection and rehabilitation of those individuals who engage in the use of

banned substances. I understand the University has a specific interest in preventing the use of

banned substances by its student-athletes at all times including the periods before, during and

after the official season of the sport or sports in which I participate.

Recognizing that the Banned Substance Use Prevention and Screening Policy (“Policy”)

has been adopted and implemented for the benefit of members of the University's athletics teams,

I hereby agree to comply fully with the provisions of the Policy as set out below.

1POLICY:

(1) PURPOSE

The purpose of adoption and implementation of this policy is twofold: a) to prevent use of banned

substances by members of all University athletic teams, and b) to detect, educate and rehabilitate

those team members who have engaged in the use of banned substances.

(2) PROHIBITION ON USE OF BANNED SUBSTANCES

Use of any of the following substances by any athletic team member, at any time, while such

individual is a student at the University, except as the same may be prescribed by a qualified

physician to treat any individual's medical condition, is expressly prohibited. For clarity, the time

period includes all times before, during or after the sport’s season or seasons in which the

student-athlete participates as a team member.

**Some legal supplements (i.e., herbal, nutritional, and other supplement(s)) may

contain banned substances, which may create a positive test result. Positive test

results for banned substances, regardless of their source, are considered violations of

this policy. You should contact your team physician or athletic trainer prior to taking

any supplement. For additional information on banned substances please visit

with a qualified athletics department staff member according to NCAA Bylaw

7.3.1.5.9. Entities other than an official authority on NCAA policy should NOT be relied

upon.

2EXAMPLES OF BANNED DRUGS

This is NOT an exhaustive list.

STIMULANTS:

Amphetamine (Adderall); caffeine (guarana); cocaine; ephedrine; methamphetamine;

methylphenidate (Ritalin); synephrine (bitter orange); methylhexaneamine (DMAA); “bath salts”

(mephedrone); Octopamine; hordenine; dimethylbutylamine (DMBA, AMP, 4-amino methylpentane

citrate); phenethylamines (PEAs); dimethylhexylamine (DMHA, Octodrine), etc.

Exceptions: phenylephrine and pseudoephedrine are not banned.

ANABOLIC AGENTS (sometimes listed as a chemical formula, such as 3,6,17-androstenetrione):

Androstenedione; boldenone; clenbuterol; DHEA (7-Keto); epi-trenbolone; etiocholanolone;

methasterone; methandienone; nandrolone; norandrostenedione; stanozolol; stenbolone;

testosterone; trenbolone; SARMS (ostarine, ligandrol, LGD-4033); etc.

ALCOHOL AND BETA BLOCKERS (banned for rifle only):

Alcohol; atenolol; metoprolol; nadolol; pindolol; propranolol; timolol; etc.

DIURETICS AND OTHER MASKING AGENTS:

Bumetanide; chlorothiazide; furosemide; hydrochlorothiazide; probenecid; spironolactone

(canrenone); triameterene; trichlormethiazide; etc.

Exceptions: finasteride is not banned.

NARCOTICS:

Buprenorphine, Dextromoramide, Diamorphine (heroin), Fentanyl, and its derivatives,

Hydrocodone, Hydromorphone, Methadone, Morphine, Nicomorphine, Oxycodone, Oxymorphone,

Pentazocine, Pethidine.

*CANNABINOIDS:

Marijuana; tetrahydrocannabinol (THC); synthetic cannabinoids (e.g., spice, K2, JWH-018, JWH-

073)

PEPTIDE HORMONES AND ANALOGUES:

Growth hormone (hGH); human chorionic gonadotropin (hCG); erythropoietin (EPO); IGF-1

(colostrum, deer antler velvet); etc.

ANTI-ESTROGENS:

Anastrozole; tamoxifen; formestane; ATD; clomiphene; SERMS (nolvadex); Arimidex; clomid;

evista; fulvestrant; aromatase inhibitors (Androst-3, 5-dien-7, 17-dione), letrozole, etc.

BETA-2 AGONISTS:

Bambuterol; formoterol; salbutamol; salmeterol; higenamine; norcoclaurine; etc.

OTHER DRUGS

Any substance that is chemically related to the class of banned drugs and/or synthetically produced

to resemble the physiology of a drug is also banned. The University, at its discretion, may add

additional substances to the list.

*Policy violations and penalties specific to cannabinoids are outlined following the policy violation

penalties for other banned substances in Part Six (6) on page 10.

(3) EDUCATION

Each academic year, the Department of Athletics Compliance should review the University’s drug

testing policy with student-athletes. During this meeting, the student-athletes should also be

informed of the NCAA drug testing program to which they will also be subjected. In addition, the

University may require student-athletes to attend supplemental educational sessions throughout

the year designed to provide education on various topics, including drug and alcohol abuse.

NCAA Bylaw 7.3.1.5.9 requires Division II institutions to designate an individual or individuals as

the athletics department resource for questions related to NCAA banned drugs and the use

of nutritional supplements. Any questions regarding NCAA banned substances/drugs/

nutritional supplements should be referred to that designee in order to properly advise student

athletes of the risks to his or her eligibility. The Resource Exchange Center (REC) is the

only authoritative resource

4recommended by the NCAA to member institutions to answer questions about supplemental

products or medications containing banned substances.

(4) SCREENING FOR USE OF BANNED SUBSTANCES

The University's Athletics Department, through the use of an independent private testing firm or its

authorized agent may, from time to time, screen or test members of all athletic teams for the

presence of any or all of the banned substances listed in Section 2. Any student-athlete’s

name that appears on a Cameron University squad list is eligible to be selected for drug testing

(except for exhausted eligibility student-athletes). The substance screening shall consist of the

collection of a urine, saliva, hair or other sample (“sample”) by the testing firm or an authorized

agent from those squad members selected. The sample shall be taken in a manner consistent

with standard professional practices. Each sample shall be analyzed for the presence of banned

substances by the testing firm contracted by the University to provide such service. The

testing firm shall specifically identify the samples that test positive. Upon notification of a

positive test result, the Department of Athletics Compliance should follow the procedures

outlined below in Section 6.

(5) ADMINISTRATION OF POLICY

The purpose of the University Department of Athletics’ drug program is twofold: (a) to prevent

the use of banned substances by members of all University athletics teams, and, (b) to detect,

educate, and rehabilitate those team members who have engaged in the use of banned

substances. In order to ensure these goals are upheld, the University may administer random

student-athlete drug testing during the playing season, during the off-season and at the

University’s discretion. In the “at-risk” sports (as defined by the NCAA Medical Aspects

Committee) for steroids -- football,

5baseball and track -- the University may also randomly select student-athletes on an athletic team’s

roster to test for steroids.

(6) VIOLATIONS OF THE POLICY*

The following may constitute violations of the Policy:

1. A positive test result;

2. Failure to comply with the education and treatment requirements;

3. A positive test result from a NCAA drug test; and/or,

4. Failure to appear for an institutional test, refusal to have testing performed or failure to comply

with the terms and conditions of a violation listed herein.

The NCAA substance testing policies and procedures may also impose sanctions that are

independent of those imposed by the University’s Banned Substance Use Prevention &

Screening Policy.

*Policy violations and penalties specific to cannabinoids are outlined following the policy violation

penalties for other banned substances in Part Six (6) on page 10.

➢ First Violation - A first violation of the Policy (at any time while a student at the University)

may result in notification of the Department of Athletics Compliance, the Athletics Director, the

Faculty Athletics Representative, the Head Athletics Trainer, the student-athlete, student-

athlete's parent(s) or legal guardian(s), his or her head coach, and the team physician for the

purpose of securing additional assistance. The student-athlete should arrange for a preliminary

chemical dependency evaluation with PROS as soon as reasonably possible. Based on the

evaluation, the team physician and the evaluating professional should determine if additional

assistance or treatment is required. The student-athlete may be required to attend professional

6medical assistance for the purpose of rehabilitation and prevention of further substance use.

The student-athlete may also be subject to weekly substance abuse tests for the remainder of

his/her time at the University.

➢ Failure to participate in required evaluation and/or treatment shall result in notification

to the student-athlete of the failure to comply and the terms and conditions that must

be met by the student-athlete for compliance. Additionally, failure to attend any

mandatory treatment session may result in a financial penalty to the student-athlete to

reimburse the University for any missed session fees incurred. Failure by the student-

athlete to comply with the terms and conditions stated in the notice may constitute a

separate and distinct violation of the Policy with consequences as set forth below,

including but not limited to, loss of complimentary tickets and/or suspension from the

next competition.

➢ Second Violation - A second violation of the Policy (at any time while a student at the

University) may result in the notification of the Department of Athletics Compliance, the Athletics

Director, the Faculty Athletics Representative, the Head Athletics Trainer, the student-athlete,

the student-athlete's parent(s) or legal guardian(s), his or her head coach, and the team

physician for the purpose of securing additional assistance. The student-athlete should be

required to obtain timely professional, rehabilitative medical assistance acceptable to the

University to prevent further substance use. In addition, the student-athlete who receives a

second violation, should be suspended from the next competition, absent exigent or extenuating

circumstances1. However, if the second violation, occurs during the offseason (i.e., after the

7final competition of the season, including post-season, and before the first competition of the

upcoming season), the student-athlete should be suspended from one of the first three

competitions of the upcoming season, determined through a random selection process. The

student-athlete may also be subject to weekly drug tests for the remainder of his/her time at the

University.

➢ Failure to participate in the required rehabilitation and prevention of substance abuse

program required above shall result in notification to the student-athlete of the failure

to comply and the terms and conditions that must be met by the student-athlete for

compliance. Additionally, failure to attend any mandatory treatment session may

result in a financial penalty to the student-athlete to reimburse the University for any

missed session fees incurred. The student-athlete may be suspended from all

athletic team participation, which includes team meetings, practice and competition

until the terms and conditions stated in the notice are met. Failure by the student-

athlete to comply with the terms and conditions of the notice may constitute a

separate and distinct violation of the Policy with consequences set forth below,

including but not limited to loss of complimentary tickets, suspension from the next

competition and/or expulsion of the student-athlete from the athletic program.

➢ Third Violation – A third violation of the Policy (at any time while a student at the University)

may result in the notification of the Department of Athletics Compliance, the Athletics Director,

the Faculty Athletics Representative, the Head Athletics Trainer, the student-athlete, the

student-athlete's parent(s) or legal guardian(s), his or her head coach, and the team physician.

8A third violation of the Policy (at any time while a student at the University) may result in the

expulsion of the student-athlete from the athletics program. The student-athlete's financial aid

for the remainder of the academic year or the renewal of financial aid for any ensuing academic

year may be revoked. If the person who receives a third positive violation is living in housing

provided by the Athletics Department, he or she may be immediately removed from housing.

The student-athlete may be reinstated to the athletics program by the Athletics Director;

however, reinstatement to the athletics program does not guarantee reinstatement to the

student-athlete’s sports team. All aspects of reinstatement to the athletics program and/or

sports team may be conditioned upon completion of a qualified drug rehabilitation program

approved by the Athletics Director. Reinstatement may be conditioned upon continued

participation in that program.

➢ Failure to participate in a required rehabilitation and prevention of substance abuse

program required above shall result in notification to the student-athlete of the failure

to comply and the terms and conditions that must be met by the student-athlete for

compliance. Additionally, failure to attend any mandatory treatment session may result

in a financial penalty to the student-athlete to reimburse the University for any missed

session fees incurred. The student-athlete may be suspended from all athletic team

participation, which includes team meetings, practice and competition until the terms

and conditions stated in the notice are met. Failure by the student-athlete to comply

with the terms and conditions of the notice may constitute a separate and distinct

violation of the Policy with consequences set forth below, including but not limited to

loss of complimentary tickets, suspension from the next competition and/or expulsion

of the student-athlete from the athletic program.

9➢ Fourth Violation – Identical to third violation without possibility of reinstatement.

VIOLATIONS OF THE POLICY SPECIFIC TO CANNABINOIDS:

• First Violation - A first violation of the Policy specific to cannabinoids (at any time while a

student athlete at the University) may result in enrollment and engagement with an

education and management plan for substance misuse as developed or facilitated by the

University (e.g., engagement with campus counseling services, participation in identified

programs to address substance misuse, enrollment in evidence-based educational

sessions, etc.).

• Second Violation - A second violation of the Policy specific to cannabinoids (at any time

while a student at the University) may result in attestation by the University that the student-

athlete (1) was compliant with the education and management plan prescribed following the

student-athlete’s first positive test; and (2) has agreed to continue to engage in an education

and management plan for substance misuse as developed or facilitated by the University

and designated to mitigate any identified at-risk behavior.

• Subsequent Violations specific to cannabinoids will be evaluated on a case-by-case

basis by PROS and the Department of Athletics Compliance to determine next steps in the

education and management plan of the student-athlete.

(7) FAILURE TO APPEAR OR REFUSAL TO TAKE TEST

Failure to appear for a test, or refusal to take a test, shall be treated as a violation of the policy as

set forth in Section 6, absent exigent or extenuating circumstances as determined by the athletics

director or designee.

10(8) NOTIFICATION OF TEST RESULTS

A student-athlete shall be notified of a positive test result following receipt of said test results from

testing facility in a timely manner. Upon a positive test result, the Athletics Compliance Department will

notify the student-athlete and request that he/she report to the Compliance office. If a student-athlete

fails to report to the designated University administrators within two (2) business days of request to

report to said administrators, the student-athlete may be removed from practice and all other team

activities until test results have been provided to the student-athlete and all other procedural

requirements have been fulfilled.

(9) APPEAL OF A POSITIVE TEST

Any student-athlete who tests positive for the use of a banned substance may appeal to the Athletics

Director. The student-athlete’s request for an appeal should be made in writing. The Athletics Director,

at his/her discretion, may reduce any suspension and/or offer probation; based on exigent and/or

mitigating circumstances. On appeal, the student-athlete will have the burden of establishing his/her

defense. During the appeal, the sanctions authorized by this policy should not be imposed until (a) the

Athletics Director has decided any appeal by the student-athlete; or, (b) the student-athlete has

withdrawn the appeal in writing. The Athletics Director’s decision should be provided in a timely manner.

(10) CONFIDENTIALITY OF TEST RESULTS

All information and records, including test results, under the Banned Substance Use Prevention and

Screening Policy, shall remain confidential. The initial results will be provided to Department of Athletics

Compliance, but shall also be available to the team physician, the Athletics Director, University Legal

Counsel, the head coach and the student-athlete's parent(s) or legal guardian(s) pursuant to Section 5.

11The test results may also be released to other physicians or individuals with whom the Athletics

Department is working to provide a rehabilitation program for the student-athlete.
